New Laws on Property Titles

A new state law will help families obtain clear title on New Orleans properties after Hurricane Katrina in a quicker, more efficient manner. The legislature approved and Gov. Bobby Jindal has signed the Louisiana Small Successions Act. The new law will give relief to thousands of residents living in homes without proper title. It expands the use of the state’s existing heirship affidavit, a mechanism that gives property heirs clear title if the total estate is valued at less than $75,000. The new law applies to any type of land and to decedents who died before the law was passed. It may be used in instances where a Louisiana property owner lived in another state and died with a will that was probated in an out-of-state court.
